Independente da forma como voc\u00ea prefere cham\u00e1-lo, este \u00e9 o assunto que vamos abordar agora. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Pode ser que voc\u00ea esteja se perguntando \u2026 <\/span><\/p>\n<p style=\"text-align: justify;\"><i><span style=\"font-weight: 400;\">&#8230; por que cargas d&#8217;\u00e1gua vamos falar sobre home office, e o que ele tem a ver com o outsourcing de impress\u00e3o?<\/span><\/i><\/p>\n<p style=\"text-align: justify;\">Mas sim, temos algo que une estes elos, que \u00e9 a d\u00favida:<\/p>\n<h4 style=\"text-align: center;\"><b>A\u00a0empresa contratante tem a obriga\u00e7\u00e3o de disponibilizar ao colaborador em home office equipamentos para que ele realize o seu trabalho?<\/b><\/h4>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Se \u00e9 uma obriga\u00e7\u00e3o ou n\u00e3o \u00e9 veremos logo adiante. Todavia, fica claro que temos nesta situa\u00e7\u00e3o um nicho de mercado a ser explorado. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Por acaso, a sua equipe de vendas j\u00e1 perguntou ao cliente se ele trabalha com colaboradores em home office? E, se sim, como a empresa d\u00e1 assist\u00eancia e disponibiliza os equipamentos para que este colaborador trabalhe com a mesma efici\u00eancia que os que ficam <em>in loco<\/em>?<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Caso a empresa cliente n\u00e3o trabalhe com este formato, pelo menos uma pulga atr\u00e1s da orelha voc\u00ea conseguiu colocar. Al\u00e9m, \u00e9 claro, de saber o que ele pensa a respeito e, se tem uma oportunidade a mais, ou n\u00e3o, para oferecer seus servi\u00e7os.<\/span><\/p>\n<h2 style=\"text-align: center;\"><b>Panorama do home office no Brasil<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">O home office \u00e9 a grande aposta das empresas para os pr\u00f3ximos anos. Este foi o resultado de uma pesquisa realizada pela SAP, Consultoria Brasileira Especializada em RH. A pesquisa tamb\u00e9m mostrou o aumento de 50% no n\u00famero de empresas brasileiras que aderiram ao trabalho remoto. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Veja mais informa\u00e7\u00e3o no panorama apresentado abaixo:<\/span><\/p>\n<h5 style=\"text-align: justify;\"><b>Fonte:<\/b> <a href=\"http:\/\/www.sobratt.org.br\/site2015\/wp-content\/uploads\/2016\/05\/Estudo_Home-_Office_Consolidado_2016.pdf\" target=\"_blank\" rel=\"noopener\">Pesquisa Home Office Brasil 2016 SAP Consultoria RH<\/a><\/h5>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">O trabalho do s\u00e9culo 21 est\u00e1 focado <strong>no que voc\u00ea faz<\/strong>, e <strong>n\u00e3o onde voc\u00ea faz<\/strong>;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">Aproximadamente 01 em cada 13 funcion\u00e1rios \u00e9 praticante da modalidade home office nas empresas;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">Aproximadamente 05 em cada 13 empresas \u00a0adotam a pr\u00e1tica do home office;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">37% das empresas pesquisadas possuem a pr\u00e1tica do home office;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">39% das empresas fazem an\u00e1lise do investimento para a tomada de decis\u00e3o na ado\u00e7\u00e3o ou manuten\u00e7\u00e3o da pr\u00e1tica de teletrabalho; \u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">28% de aumento na formaliza\u00e7\u00e3o do trabalho home office;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">68% das empresas adotam alguma modalidade de teletrabalho;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">89% das empresas praticantes utilizam a pr\u00e1tica como estrat\u00e9gia para atra\u00e7\u00e3o de colaboradores;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">80% das empresas praticantes implantaram o home office nos \u00faltimos 05 anos;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">23% das empresas praticantes promoveram redu\u00e7\u00e3o de espa\u00e7o f\u00edsico nos \u00faltimos 02 anos;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">66%\u00a0 das empresas consideram o trabalho remoto como ferramenta para enfrentar \u00e9pocas de crise econ\u00f4mica;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">32% das empresas adotam a pr\u00e1tica BYOD. (BYOD \u00e9 o termo criado para descrever a tend\u00eancia que incentiva aos profissionais utilizarem seus pr\u00f3prios dispositivos para trabalhar);<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">Em 48% das empresas o tempo gasto para a implementa\u00e7\u00e3o do teletrabalho foi de at\u00e9 06 meses;<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><strong>Entre as principais dificuldades encontradas na implanta\u00e7\u00e3o est\u00e3o a tecnologia e a infraestrutura;<\/strong><\/li>\n<li style=\"font-weight: 400; text-align: justify;\"><span style=\"font-weight: 400;\">Mais de 60% das empresas que praticam o home office s\u00e3o dos setores de: tecnologia da informa\u00e7\u00e3o e telecom; qu\u00edmico, petroqu\u00edmico e agroqu\u00edmico; servi\u00e7os de suporte e provimento; bens de consumo e m\u00e1quinas e equipamentos de automa\u00e7\u00e3o.\u00a0<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">At\u00e9 pouco tempo atr\u00e1s o home office n\u00e3o constava na legisla\u00e7\u00e3o trabalhista brasileira. Com a reforma trabalhista <\/span><span style=\"font-weight: 400;\">algumas regras referentes ao trabalho em regime home office entraram para a CLT. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">A Lei n\u00ba 13.467\/2017, que trata da reforma trabalhista,\u00a0incluiu\u00a0um novo cap\u00edtulo (Cap\u00edtulo II-A) na CLT, tendo in\u00edcio no artigo 75-B, o qual definiu o teletrabalho como sendo: <\/span><\/p>\n<blockquote>\n<h4 style=\"text-align: left;\"><b>\u201cA presta\u00e7\u00e3o de servi\u00e7os preponderantemente fora das depend\u00eancias do empregador, com a utiliza\u00e7\u00e3o de tecnologias de informa\u00e7\u00e3o e de comunica\u00e7\u00e3o que, por sua natureza, n\u00e3o se constitua como trabalho externo.\u201d<\/b><\/h4>\n<\/blockquote>\n<h2 style=\"text-align: center;\"><b>A pergunta que n\u00e3o quer calar: quem \u00e9 o respons\u00e1vel pelo equipamento de trabalho no home office?<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">A lei trabalhista n\u00e3o especificou quem dever\u00e1 arcar com as despesas relacionadas \u00e0 aquisi\u00e7\u00e3o, manuten\u00e7\u00e3o e fornecimento dos equipamentos necess\u00e1rios para o trabalho \u2014 tecnol\u00f3gicos ou referentes \u00e0 infraestrutura.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Esta brecha deixa livre a negocia\u00e7\u00e3o entre as partes a respeito da responsabilidade por esses gastos. Esta responsabilidade, em via de regra, deve ser estabelecida no contrato de trabalho, incluindo se a empresa ser\u00e1 respons\u00e1vel por disponibilizar os equipamentos e bancar uma parte dos gastos com conta de internet e luz, por exemplo, ou se o colaborador ir\u00e1 arcar com os custos.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Conforme o<\/span> <strong><a href=\"https:\/\/www.jusbrasil.com.br\/topicos\/173000254\/artigo-75d-do-decreto-lei-n-5452-de-01-de-maio-de-1943\" target=\"_blank\" rel=\"noopener\">artigo 75-D da CLT<\/a><\/strong><span style=\"font-weight: 400;\">, <\/span><span style=\"font-weight: 400;\">deve estar previsto em contrato os detalhes, como: quem adquire, mant\u00e9m ou fornece os instrumentos tecnol\u00f3gicos e a infraestrutura necess\u00e1ria.<\/span><\/p>\n<blockquote>\n<h4 style=\"text-align: left;\"><b>\u201cAs disposi\u00e7\u00f5es relativas \u00e0 responsabilidade pela aquisi\u00e7\u00e3o, manuten\u00e7\u00e3o ou fornecimento dos equipamentos tecnol\u00f3gicos e da infraestrutura necess\u00e1ria e adequada \u00e0 presta\u00e7\u00e3o do trabalho remoto, bem como ao reembolso de despesas arcadas pelo empregado, ser\u00e3o previstas em contrato escrito.\u201d <\/b><\/h4>\n<h5 style=\"text-align: left;\"><span style=\"font-weight: 400;\">Artigo 75-D da CLT<\/span><\/h5>\n<\/blockquote>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Importante destacar, que a lei deixa claro que quando estas despesas forem arcadas pela empresa elas n\u00e3o podem integrar a <\/span><span style=\"font-weight: 400;\">remunera\u00e7\u00e3o do colaborador.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Vale a pena recordar, nesta situa\u00e7\u00e3o, o que diz o artigo 2\u00ba da CLT: <em>&#8220;O empregado n\u00e3o \u00e9 o respons\u00e1vel pelo custo do neg\u00f3cio&#8221;<\/em> e que <em>\u201co empregador deve assumir os riscos da atividade econ\u00f4mica&#8221;<\/em><\/span><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Agora que voc\u00ea j\u00e1 tem um esclarecimento pr\u00e9vio sobre o assunto, \u00e9 v\u00e1lida a reflex\u00e3o se a sua empresa de outsourcing tem as condi\u00e7\u00f5es necess\u00e1rias para atender esta demanda e, como ela pode ser ofertada aos potenciais clientes.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Sempre que o assunto se relaciona com leis \u00e9 important\u00edssimo que voc\u00ea converse com uma assessoria jur\u00eddica, assim estar\u00e1 totalmente preparado e amparado legalmente. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Veja outras publica\u00e7\u00f5es do Blog da PrintWayy.
