Veja quais s\u00e3o as caracter\u00edsticas que determinam eles, para classificar de maneira correta o seu outsourcing.<\/span><\/p>\n<h2 style=\"text-align: center;\"><b>Defini\u00e7\u00f5es de portes de empresa<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Existem <\/span><b>05 classifica\u00e7\u00f5es<\/b><span style=\"font-weight: 400;\"> de portes de empresa &#8211; microempreendedores individuais, microempresas, pequenas, m\u00e9dias ou grandes, as quais dependem de alguns fatores que voc\u00ea ir\u00e1 conferir a seguir.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">No entanto, \u00e9 necess\u00e1rio compreender inicialmente que eles podem mudar de acordo com as defini\u00e7\u00f5es de cada \u00f3rg\u00e3o governamental, e tamb\u00e9m ser alterado futuramente, com a evolu\u00e7\u00e3o que a empresa apresentar.<\/span><\/p>\n<p style=\"text-align: justify;\"><b><span style=\"color: #0872c4;\">Microempreendedor Individual (MEI)<\/span>:<\/b><span style=\"font-weight: 400;\"> \u00e9 o menor porte de empresas que existe no pa\u00eds, e pode ser aderido por aquelas que realizam atividades com faturamento de at\u00e9 R$ 81 mil por ano. Ele \u00e9, ao mesmo tempo que um tipo de empresa, tamb\u00e9m uma defini\u00e7\u00e3o de porte.<\/span><\/p>\n<p style=\"text-align: justify;\"><b><span style=\"color: #0872c4;\">Microempresa (ME)<\/span>:<\/b><span style=\"font-weight: 400;\"> neste porte, os empreendimentos atingem at\u00e9 R$ 360 mil por ano, e \u00e9 regido pela<\/span> <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/lcp\/lcp123.htm\" target=\"_blank\" rel=\"noopener\"><b>Lei Complementar 123\/06<\/b><\/a><span style=\"font-weight: 400;\"> &#8211; Estatuto Nacional da Microempresa e da Empresa de Pequeno Porte.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Quem faz parte deste porte pode optar pelo Simples Nacional, regime tribut\u00e1rio especial para micro e pequenas empresas. Nele, h\u00e1 tributos reduzidos e o c\u00e1lculo dos impostos \u00e9 mais simples. No entanto, \u00e9 reservado a apenas algumas empresas, dependendo da atividade que exercem.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0872c4;\"><b>Empresa de Pequeno Porte (EPP)<\/b><\/span><span style=\"font-weight: 400;\"><strong>:<\/strong> tamb\u00e9m legislado pela <\/span><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/lcp\/lcp123.htm\" target=\"_blank\" rel=\"noopener\"><b>Lei Complementar 123\/06<\/b><\/a><span style=\"font-weight: 400;\"> &#8211; Estatuto Nacional da Microempresa e da Empresa de Pequeno Porte, <\/span><span style=\"font-weight: 400;\">s\u00e3o empresas que faturam at\u00e9 4,8 milh\u00f5es ao ano.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Elas podem ainda optar pelo Simples Nacional, se esse for o melhor regime de acordo com a situa\u00e7\u00e3o da empresa e para isso, uma conversa com o contador \u00e9 fundamental.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">J\u00e1 alguns \u00f3rg\u00e3os federais classificam os portes empresariais da seguinte maneira:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">A <\/span><span style=\"color: #0872c4;\"><b>Anvisa (Ag\u00eancia Nacional de Vigil\u00e2ncia Sanit\u00e1ria)<\/b><\/span><span style=\"font-weight: 400;\">, determina por faturamento anual:\u00a0<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Grupo I &#8211; Empresa de Grande Porte: superior a R$ 50 milh\u00f5es;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Grupo II &#8211; Empresa de Grande Porte: igual ou inferior a R$ 50 milh\u00f5es e superior a R$ 20 milh\u00f5es;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Grupo III \u2013 Empresa de M\u00e9dio Porte: igual ou inferior a R$ 20 milh\u00f5es e superior a R$ 6 milh\u00f5es;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Empresa de Pequeno Porte (EPP): igual ou inferior a R$ 4,8 milh\u00f5es e superior a R$ 360 mil;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Microempresa: igual ou inferior a R$360 mil.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">O <\/span><span style=\"color: #0872c4;\"><b>IBGE (<\/b><b>Instituto Brasileiro de Geografia e Estat\u00edstica)<\/b><\/span><span style=\"font-weight: 400;\">, classifica<\/span><span style=\"font-weight: 400;\"> por n\u00famero de colaboradores:\u00a0<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Micro: at\u00e9 9 (com\u00e9rcio e servi\u00e7os) ou at\u00e9 19 (ind\u00fastria);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pequena: entre 10 e 49 (com\u00e9rcio e servi\u00e7os) ou de 20 at\u00e9 99 colaboradores (ind\u00fastria);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">M\u00e9dia: entre 50 e 99 (com\u00e9rcio e servi\u00e7os) ou de 100 at\u00e9 499 (ind\u00fastria);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Grande: mais de 100 (com\u00e9rcio e servi\u00e7os) ou mais de 500 (ind\u00fastria).<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">O <\/span><span style=\"color: #0872c4;\"><b>BNDES (<\/b><b>Banco Nacional do Desenvolvimento)<\/b><\/span><span style=\"font-weight: 400;\">, utiliza o faturamento, pela Receita Operacional Bruta ou Renda Anual e, aplica essa divis\u00e3o a fim de oferecer cr\u00e9dito e programas espec\u00edficos de acordo com o porte da empresa:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Microempresa: menor ou igual a R$ 360 mil;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pequena empresa: maior que R$ 360 mil e menor ou igual a R$ 4,8 milh\u00f5es;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">M\u00e9dia empresa: maior que R$ 4,8 milh\u00f5es e menor ou igual a R$ 300 milh\u00f5es;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Grande empresa: maior que R$ 300 milh\u00f5es.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">J\u00e1 a <\/span><b><span style=\"color: #0872c4;\">Pol\u00edtica Nacional do Meio Ambiente<\/span> (<\/b><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l6938.htm\" target=\"_blank\" rel=\"noopener\"><b>Lei n. 6.938<\/b><\/a><b>)<\/b><span style=\"font-weight: 400;\">, diferencia os portes de acordo com o faturamento anual. E \u00e9 estabelecido da seguinte maneira:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Empresa de M\u00e9dio Porte: at\u00e9 R$ 12 milh\u00f5es;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Empresa de Grande Porte: acima de R$ 12 milh\u00f5es.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">No MEI, \u00e9 poss\u00edvel realizar o processo de abertura pelo <\/span><a href=\"https:\/\/www.gov.br\/empresas-e-negocios\/pt-br\/empreendedor\/quero-ser-mei\" target=\"_blank\" rel=\"noopener\"><b>Portal do Empreendedor<\/b><\/a> <span style=\"font-weight: 400;\">e tirar muitas d\u00favidas sobre as vantagens, benef\u00edcios e obriga\u00e7\u00f5es desse porte. J\u00e1 nos outros, \u00e9 necess\u00e1rio comparecer at\u00e9 a Junta Comercial na Prefeitura para dar in\u00edcio ao empreendimento.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u26a0\ufe0f <\/span><span style=\"text-decoration: underline;\"><b>Cuidado para n\u00e3o confundir<\/b><\/span><span style=\"font-weight: 400;\">: os portes da empresa mostram qual o tamanho dela quanto ao faturamento, como vimos acima, j\u00e1 a natureza jur\u00eddica \u00e9 como se d\u00e1 a sua forma\u00e7\u00e3o e como ela funcionar\u00e1.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Entre as naturezas jur\u00eddicas, h\u00e1 o Empres\u00e1rio Individual (EI), Empresa Individual de Responsabilidade Limitada (EIRELI), Sociedade Simples, Sociedade Empres\u00e1ria Limitada (LTDA) Sociedade Limitada Unipessoal (SLU), e Sociedade An\u00f4nima (S\/A).\u00a0<\/span><\/p>\n<h4 style=\"text-align: justify;\"><b>O cen\u00e1rio brasileiro atual de empresas<\/b><span style=\"font-weight: 400;\">:<\/span><\/h4>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.gov.br\/economia\/pt-br\/assuntos\/noticias\/2022\/julho\/mais-de-1-3-milhao-de-empresas-sao-criadas-no-pais-em-quatro-meses#:~:text=Com%20esse%20resultado%2C%20o%20total,ao%20primeiro%20quadrimestre%20de%202022\" target=\"_blank\" rel=\"noopener\"><b>Dados do Governo Federal<\/b><\/a><span style=\"font-weight: 400;\"> informam ainda que <\/span><span style=\"font-weight: 400;\">as micro e pequenas empresas (MPEs) representam 99% do total das empresas brasileiras, s\u00e3o respons\u00e1veis por 62% dos empregos e por 27% do Produto Interno Bruto (PIB).\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Outra informa\u00e7\u00e3o relevante prestada na not\u00edcia \u00e9 que, mais de 40% dos microempreendedores individuais (MEI) s\u00e3o mulheres empreendedoras.<\/span><\/p>\n<h2 style=\"text-align: center;\"><b>Como o porte da empresa \u00e9 alterado<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">O porte atual da sua empresa pode ser conferido no seu Cart\u00e3o CNPJ e a mudan\u00e7a dele segue de acordo com as informa\u00e7\u00f5es que s\u00e3o prestadas para a Receita Federal.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">O porte da empresa se d\u00e1 a partir da declara\u00e7\u00e3o realizada anualmente, considerando o faturamento informado.
